NOSTALGIQUE LLC WEBSITE TERMS OF SERVICE **Effective Date:** August 6, 2026 **Last Updated:** August 6, 2026 These Terms of Service (“Terms”) govern access to and use of websites, online forms, assessments, digital content, communications, and other online resources operated by **Nostalgique LLC**, a New York limited liability company doing business as **Nostalgique Hospitality Group, Nostalgique Lifestyles, and Nostalgique** (“Nostalgique,” “Company,” “we,” “us,” or “our”). By accessing or using our website or online services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to these Terms, please discontinue use of the website and online services. 1. PURPOSE OF OUR WEBSITE Nostalgique provides household hospitality, lifestyle support, household coordination, Membership, and related services. Our website may allow individuals to: * Learn about Nostalgique; * Learn about available services and Membership opportunities; * Participate in complimentary assessments; * Request or receive information; * Communicate with Nostalgique; * Access reports, plans, educational materials, or other resources; * Request information about becoming a Member; and * Use other features that Nostalgique may make available. Use of the website does not, by itself, establish a Member relationship, service agreement, agency relationship, employment relationship, fiduciary relationship, or other professional relationship between you and Nostalgique. A Nostalgique Membership or paid service relationship is established only through the applicable enrollment, agreement, authorization, payment, or other process required by Nostalgique.  2. ELIGIBILITY You may use the website only if you have the legal capacity to agree to these Terms. If you provide information on behalf of another individual, household, business, or organization, you represent that you are authorized to provide that information. The website is not intended to solicit personal information directly from children. Adults providing household information concerning children should provide only information reasonably necessary for the purpose for which it is requested. --- ## 3. ACCEPTABLE USE You agree to use the website only for lawful purposes. You may not: * Submit information you know to be materially false, fraudulent, or misleading; * Impersonate another person; * Attempt to obtain unauthorized access to Company systems or information; * Interfere with the operation or security of the website; * Introduce viruses, malicious software, automated attacks, or harmful code; * Scrape, harvest, or systematically collect website information without authorization; * Use Company materials in violation of Nostalgique's intellectual-property rights; * Attempt to reverse engineer restricted Company systems, methodologies, or technology; * Use the website to harass, threaten, defraud, or harm another person; or * Use the website in violation of applicable law. Nostalgique may restrict or terminate access to the website where reasonably necessary to protect the Company, its users, its systems, or others. --- # 4. COMPLIMENTARY HOUSEHOLD HOSPITALITY ASSESSMENT Nostalgique may offer a complimentary Household Hospitality Assessment and related reports, plans, recommendations, or resources. ### The Assessment Is Complimentary The Household Hospitality Assessment is provided **100% complimentary**. No purchase is required to complete the Assessment or receive the standard complimentary results associated with it. Completion of an Assessment does not obligate you to purchase a Nostalgique Membership, product, or service. ### The Assessment Is Not a Grade The Assessment is intended to help Nostalgique better understand information you voluntarily provide concerning your household experience, priorities, time and capacity, support needs, and desired outcomes. The Household Hospitality Assessment is **not a test or judgment of your household**. Any baseline, score, observation, recovery opportunity, recommendation, or plan generated from the Assessment should not be interpreted as a determination of personal success, failure, competency, or worth. The Household Hospitality Score, when provided, establishes a baseline from which potential recovery opportunities may be considered. --- # 5. ASSESSMENT IDENTITY OPTIONS Nostalgique recognizes that some participants may prefer not to provide their full names when completing an Assessment. Where permitted by the Assessment interface, participants may provide **initials instead of their full name**. Additional identifying information may be necessary where a participant later requests services, enters into an agreement with Nostalgique, makes a payment, requires identity verification, or engages in another activity for which additional information is reasonably necessary. --- # 6. ASSESSMENT DELIVERY Participants may be offered options for receiving their completed Household Hospitality Assessment results, including: **Email Delivery** or **Telephone Review** Contact information provided for delivery of Assessment results will be used in accordance with our Privacy Policy and the preferences selected by the participant. --- # 7. TELEPHONE ASSESSMENT REVIEW If you select telephone delivery, you authorize Nostalgique to contact you at the telephone number you provide for purposes reasonably related to delivering, reviewing, explaining, scheduling, or clarifying your Assessment results. **Selecting telephone delivery does not constitute a request for a sales consultation.** A Nostalgique Hospitality Operator may review your Household Hospitality Baseline, current strengths, recovery opportunities, desired experiences, capacity considerations, and 30-Day Hospitality Plan with you. The purpose of that conversation is to understand your household and review your Assessment results. --- # 8. NO-SALES-PRESSURE COMMITMENT Nostalgique does not require a sales consultation as a condition of completing the complimentary Assessment or receiving its standard results. Nostalgique representatives shall not use the Assessment process to pressure, improperly influence, or manufacture urgency for the purpose of obtaining a purchase. Membership or paid services may be discussed if you request information about them or otherwise indicate that you wish to explore Nostalgique's assistance. Declining to purchase services will not invalidate your Assessment, complimentary report, or standard 30-Day Hospitality Plan. --- # 9. ASSESSMENT INFORMATION AND ACCURACY Assessment results depend substantially upon information supplied by the participant. You are encouraged to provide information that accurately represents your current household experience. Nostalgique does not independently verify every statement or response submitted through an Assessment. Assessment findings, recovery opportunities, capacity estimates, suggested interventions, and Hospitality Plans may involve professional judgment and reasonable assumptions based upon the information available at the time. Results may change when additional or more accurate information becomes available. --- # 10. NO GUARANTEE OF RESULTS Nostalgique seeks to provide thoughtful and useful Assessment findings. However, Nostalgique does not guarantee that an Assessment, recommendation, Hospitality Plan, Membership, or particular intervention will produce a specific result. Examples of results that cannot be guaranteed include: * A particular number of hours recovered; * A specific improvement in household capacity; * Financial savings; * Particular lifestyle improvements; * Availability of third-party professionals; * Completion of household projects within a particular timeframe; or * A specific change in a Household Hospitality Score. Any stated recovery goal represents an objective or planning target and is not a guaranteed outcome unless expressly agreed otherwise in a separate written agreement. --- # 11. INFORMATIONAL NATURE OF CONTENT Website content, Assessments, Household Hospitality Reports, Hospitality Plans, recommendations, educational materials, and similar resources are provided for household hospitality, lifestyle-support, informational, and planning purposes. Unless expressly stated otherwise, they do not constitute: * Legal advice; * Medical advice; * Mental-health advice; * Financial or investment advice; * Tax advice; * Engineering advice; * Professional childcare advice; * Home-inspection services; * Safety certification; or * Other regulated professional advice. Where specialized expertise is necessary, users should consult an appropriately qualified professional. --- # 12. THIRD-PARTY PROFESSIONALS AND VENDORS An Assessment or Hospitality Plan may identify household needs that could potentially be addressed by an independent professional or vendor. Nostalgique may identify, coordinate with, or recommend third-party professionals where appropriate. Unless expressly stated otherwise in a separate written agreement, independent third-party professionals are not employees, agents, or representatives of Nostalgique merely because Nostalgique identifies, recommends, or coordinates with them. Third-party professionals may establish their own pricing, availability, terms, policies, warranties, licensing requirements, and service standards. You are responsible for reviewing and agreeing to any applicable third-party terms before purchasing services directly from a third party. --- # 13. AUTHORIZATION BEFORE VENDOR DISCLOSURE Nostalgique will not provide your personal information to an outside household professional or vendor for that professional's independent marketing or sales purposes without appropriate authorization. Where you request that Nostalgique connect you with, coordinate with, or obtain information from a third-party professional, you authorize Nostalgique to disclose information reasonably necessary to fulfill that request. The nature of such disclosures and applicable privacy practices are further addressed in our Privacy Policy. --- # 14. PRIVACY Your privacy is important to Nostalgique. Our collection, use, retention, disclosure, and protection of personal information are addressed in the Nostalgique Privacy Policy and applicable notices presented when information is collected. **Nostalgique does not sell personal information or share Assessment information with third parties for their independent marketing or sales purposes.** Nostalgique may use service providers that perform legitimate operational functions on its behalf, such as website hosting, communications, data storage, security, analytics, form processing, and similar business functions. Use of such service providers does not constitute authorization for those providers to independently market their products or services to Assessment participants using information provided to Nostalgique. The complete Privacy Policy should be reviewed together with these Terms. --- # 15. COMMUNICATIONS When you provide contact information to Nostalgique, you authorize communications reasonably necessary to fulfill the purpose for which that information was provided. For example, if you request Assessment results by email, Nostalgique may email you concerning those results. If you request a telephone Assessment review, Nostalgique may contact you to schedule, deliver, or follow up regarding that review. Providing contact information for an Assessment does not, by itself, constitute consent to receive unrelated promotional communications where separate consent is required by law. You may request changes to applicable communication preferences by contacting Nostalgique. --- # 16. MEMBERSHIP AND PAID SERVICES These Terms primarily govern the Nostalgique website and online resources. They are **not the Nostalgique Membership Agreement**. Memberships, recurring services, household access, payment obligations, scheduling, cancellations, service hours, Member responsibilities, vendor coordination, and other paid-service matters may be governed by separate written agreements, policies, authorizations, or terms. Where a separate written agreement expressly conflicts with these Website Terms concerning a paid service, the applicable service agreement will control with respect to that service. --- # 17. PRICING AND WEBSITE INFORMATION Nostalgique may publish information concerning Memberships, services, fees, availability, or other offerings. We seek to keep such information accurate but may correct errors or update information where permitted by law. Website information does not create a binding service commitment unless and until Nostalgique accepts the applicable enrollment, order, agreement, or service request. --- # 18. INTELLECTUAL PROPERTY Unless otherwise indicated, the website and its original content, systems, written materials, graphics, branding, forms, Assessment materials, reports, frameworks, methodologies, training concepts, designs, and other Company-created materials are owned by or licensed to Nostalgique LLC and are protected by applicable intellectual-property laws. This may include, without limitation, Company materials associated with the: **Household Hospitality Assessment** **Household Hospitality Score** **Hospitality Plan** **Member Acquisition Engine (MAE)** and other Nostalgique systems, forms, processes, and materials. Use of the website does not transfer ownership of Nostalgique intellectual property to you. --- # 19. LIMITED PERSONAL USE Nostalgique grants users a limited, revocable, non-exclusive, non-transferable right to access and use website materials for their intended personal purposes. A recipient may use their own Household Hospitality Report or 30-Day Hospitality Plan for their personal household purposes. Unless Nostalgique provides written permission, users may not reproduce, sell, license, commercially distribute, publish, modify, create competing products from, or commercially exploit Nostalgique proprietary materials. Nothing in these Terms prevents a participant from using the personal recommendations contained in their own Hospitality Plan for their household. ---# 19a. NOSTALGIQUE HOUSE UNIVERSITY Nostalgique House University is an educational program operated by Nostalgique LLC. NHU is not an accredited college or university. NHU Learning Hours are not academic credit hours. NHU Certificates of Completion do not constitute academic degrees, professional licenses, governmental certifications, college credit, or guarantees of employment. --- # 20. TRADEMARKS AND BRANDING Nostalgique LLC's names, trade names, logos, slogans, service names, designs, and related branding may constitute trademarks or other protected intellectual property. No license to use Nostalgique branding is granted except as expressly authorized in writing. References to third-party trademarks remain the property of their respective owners. --- # 21. USER SUBMISSIONS You retain ownership of information and original content that you submit through the website to the extent you hold rights in that material. You grant Nostalgique permission to process, store, reproduce, analyze, and otherwise use submitted information as reasonably necessary to: * Provide the requested Assessment or service; * Prepare reports and Hospitality Plans; * Communicate with you; * Operate and improve Nostalgique's services; * Maintain business records; * Protect Company systems and users; and * Comply with applicable legal obligations. Our handling of personal information remains subject to the Privacy Policy and applicable law. --- # 22. FEEDBACK If you voluntarily provide suggestions, ideas, comments, or feedback concerning Nostalgique's services or systems, Nostalgique may use that feedback to improve its operations and offerings without an obligation to compensate you, provided that doing so does not authorize Nostalgique to publicly identify you or disclose your personal information contrary to our Privacy Policy. --- # 23. THIRD-PARTY WEBSITES AND SERVICES The website may contain links to or integrations with third-party websites, platforms, applications, or services. Nostalgique does not control every third-party service and is not responsible for third-party content, privacy practices, security, availability, or terms. Access to third-party services may be governed by the terms and privacy policies of those providers. --- # 24. WEBSITE AVAILABILITY Nostalgique seeks to maintain reliable online services but does not guarantee uninterrupted or error-free access. The website may occasionally become unavailable because of maintenance, technical failures, security issues, third-party service interruptions, updates, or circumstances outside Nostalgique's reasonable control. Nostalgique may modify, suspend, replace, or discontinue website features when reasonably necessary, subject to applicable law and contractual obligations. --- # 25. WEBSITE SECURITY Users may not attempt to bypass security measures, test vulnerabilities without authorization, obtain unauthorized information, interfere with other users, or otherwise compromise Nostalgique systems. Nostalgique may take reasonable actions to investigate suspected misuse and protect its systems, users, intellectual property, and information. --- # 26. DISCLAIMER OF WARRANTIES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND COMPLIMENTARY ONLINE RESOURCES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. NOSTALGIQUE DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, COMPLETELY ERROR-FREE, OR SUITABLE FOR EVERY INDIVIDUAL PURPOSE. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded under applicable law. --- # 27. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOSTALGIQUE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM USE OF, OR INABILITY TO USE, THE WEBSITE OR COMPLIMENTARY ONLINE RESOURCES. Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited. Separate liability provisions may apply to Memberships and paid services under the applicable service agreement. --- # 28. INDEMNIFICATION To the extent permitted by applicable law, you agree to indemnify and hold harmless Nostalgique LLC and its officers, employees, and representatives from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of the website, your material violation of these Terms, or your infringement of another person's rights. This provision does not require indemnification for losses caused solely by Nostalgique's own unlawful conduct where such indemnification would be prohibited by law. --- # 29. SUSPENSION OR TERMINATION OF ACCESS Nostalgique may suspend or terminate access to the website or particular online resources where reasonably necessary because of: * Material violation of these Terms; * Fraudulent activity; * Security threats; * Unlawful conduct; * Abuse of Company systems; or * Protection of Nostalgique, its users, or third parties. Provisions that by their nature should survive termination shall remain effective to the extent permitted by law. --- # 30. GOVERNING LAW These Terms shall be governed by and interpreted under the laws of the **State of New York**, without regard to conflict-of-laws principles, except where applicable law requires otherwise. --- # 31. DISPUTE RESOLUTION Before commencing formal legal proceedings concerning these Terms, you and Nostalgique agree, where reasonable and legally permissible, to attempt in good faith to resolve the dispute through direct written communication. Any forum-selection, arbitration, class-action waiver, or similar dispute provision applicable to Membership or paid services may be addressed separately in the applicable service agreement. --- # 32. NEW YORK CONSUMER RIGHTS Nothing in these Terms is intended to waive, restrict, or eliminate any consumer right or remedy that cannot lawfully be waived under applicable federal, New York State, or other applicable law. If any provision of these Terms conflicts with a mandatory consumer-protection requirement, the applicable legal requirement shall control to the extent of the conflict. --- # 33. CHANGES TO THESE TERMS Nostalgique may update these Terms from time to time to reflect changes in our website, practices, services, technology, or legal requirements. When changes are made, the **Last Updated** date at the beginning of these Terms will be revised. Material changes will be communicated or presented as required by applicable law. Continued use of the website following an update constitutes acceptance only to the extent permitted by applicable law. --- # 34. SEVERABILITY If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary, where permitted, and the remaining provisions shall continue in effect. --- # 35. NO WAIVER Failure by Nostalgique to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or any other right. --- # 36. ENTIRE AGREEMENT FOR WEBSITE USE These Terms, together with the Nostalgique Privacy Policy and any notices expressly incorporated into them, constitute the agreement between you and Nostalgique concerning general use of the website. Separate agreements may govern Membership, paid services, employment, vendor relationships, or other relationships with Nostalgique. --- # 37.
